Welcome to Ben McCarthy Mentorship Services ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our mentorship services, including one-on-one coaching sessions, group workshops, and digital resources.
By booking a session or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Our Services
We provide executive-level AI mentorship and strategic guidance services including:
- AI strategy mentorship for senior professionals
- Executive-level AI implementation coaching
- Strategic AI frameworks and templates
- Professional development and workflow optimization
- Industry-specific AI application guidance
- Digital resources, templates, and implementation materials
Important: Our services focus on AI tool implementation and strategic guidance. We do not provide financial, legal, medical, or other regulated professional advice. All guidance is educational in nature.
Session Cancellation Policy
Client Cancellations
- 24+ hours notice: Full refund or free rescheduling
- 12-24 hours notice: 50% refund or free rescheduling
- Less than 12 hours notice: No refund, rescheduling subject to 50% fee
- No-shows: Full session fee charged, no refund
Emergency Circumstances
We understand that genuine emergencies occur. In cases of medical emergencies, family crises, or other extraordinary circumstances, please contact us immediately. We will work with you on a case-by-case basis to find a fair solution.
Mentor Cancellations
If we need to cancel or reschedule a session, you will receive full refund or priority rescheduling at no additional cost. We will provide as much advance notice as possible.
Refund Policy
30-Day Money-Back Guarantee
We offer a comprehensive 30-day money-back guarantee for our executive mentorship programs. If you are not completely satisfied with the value and quality of our mentorship services, you may request a full refund within 30 days of your program start date.
Guarantee Conditions
- Must request refund within 30 calendar days of program commencement
- Must have completed application of at least one method or framework taught in the program
- Must provide written feedback detailing specific concerns with the service
- Applies to full program purchases only (not individual sessions)
- Must have attended at least 50% of scheduled sessions or reviewed 50% of provided materials
Guarantee Process
- Contact us at ben@earthandwonder.com with your refund request
- Provide program completion evidence and specific feedback
- Allow 2-3 business days for review and response
- Upon approval, refund will be processed within 5-10 business days
- Refund will be issued to original payment method
Other Eligible Circumstances
- Session cancelled with proper notice (as outlined above)
- Technical issues preventing session completion on our end
- Mentor-initiated cancellations
- Service not delivered as described
- Billing errors or duplicate charges
Refund Processing
- Processing time: 5-10 business days from approval
- Method: Refunds will be issued to the original payment method
- Partial sessions: Prorated refunds available for incomplete sessions due to technical issues
Non-Refundable Items
- Completed sessions where service was delivered as promised (beyond 30-day guarantee period)
- Digital resources and templates after download/access (beyond 30-day guarantee period)
- Late cancellations and no-shows (as per cancellation policy)
- Services used more than 30 days ago (except under guarantee conditions above)
- Requests that do not meet the guarantee conditions outlined above
Intellectual Property
Our Materials
All templates, worksheets, guides, frameworks, and other materials provided during mentorship sessions are proprietary to Ben McCarthy Mentorship Services. You receive a personal, non-transferable license to use these materials for your own development and business purposes.
Permitted Use
- Personal and business application of concepts and frameworks
- Implementation of strategies discussed in sessions
- Customization of templates for your specific needs
Prohibited Use
- Reselling, redistributing, or sharing our proprietary materials
- Creating derivative works for commercial distribution
- Using our materials to compete directly with our services
- Removing copyright notices or attribution
Your Content
You retain ownership of any ideas, concepts, or materials you bring to our sessions. We may use anonymized insights and general learnings to improve our services, but will not share your specific confidential information.
Limitation of Liability

Client Responsibilities

- Arrive punctually for scheduled sessions

- Respect confidentiality of other clients if in group settings
- Use provided materials responsibly and within permitted terms
- Provide feedback to help us improve our services

We maintain strict confidentiality regarding your personal and business information shared during sessions. We will not disclose your information to third parties without your explicit consent, except as required by law.
In return, we ask that you respect the confidentiality of our proprietary methods, strategies, and materials.
Dispute Resolution
Direct Communication
We believe most issues can be resolved through open communication. If you have concerns about our services, please contact us directly at ben@earthandwonder.com to discuss the matter.
Formal Resolution Process
- Initial Contact: Written notification of the dispute within 30 days of the issue
- Good Faith Discussion: 30-day period for direct negotiation and resolution attempts
- Mediation: If needed, binding mediation through a mutually agreed upon mediator
- Arbitration: Final binding arbitration if mediation is unsuccessful
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any legal proceedings will be conducted in the courts of New South Wales, Australia.
Payment Terms
- Payment is required at time of booking unless other arrangements are made
- We accept major credit cards and electronic payments
- Prices are subject to change with 30 days notice for future bookings
- Any applicable taxes will be added to the stated price
- Late payment fees may apply to overdue accounts
